If i have representation by a lawyer should my opposing lawyer be able to have a vacate property delivered to?

my common law husband of 15 yrs ped away with no will my name is on purchase agreement but not deed as I did not have prove of income when we applied to bank for mortgage. My lawyer contacted estate lawyer with my request to keep the house, several Mt's ped no word I live in my home, I continue to pay all bills as they were in my name since we bought the house. Last week I received a tenant vacate property notice. Shouldn't the lawyer of sent this to my lawyer. I live in Fort Mcmurray, AB, canada
